Abstract

ABSTRACT In 2010 the State Electricity Company (PLN) issued a new policy by implementing a new system, namely the smart electricity system (Prepaid) in which customers spend money/costs in advance to buy electrical energy to be consumed. With the enactment of a policy regarding the use of Prepaid Meters by PT PLN, all electricity consumers are encouraged to use the meter. Electricity consumers in the Pekanbaru District Simpang Tiga area who use Postpaid Meters are also encouraged to replace their meters with Prepaid Meters without being charged by PT. PLN, this is done to attract the attention of electricity consumers to switch to using Prepaid Meters. The formulation of the problem in this study is how to implement a prepaid electricity purchase agreement according to Law Number 8 of 1999 concerning Consumer Protection between Customers and PT. PLN (Persero) Pekanbaru Area Simpang Tiga Rayon and what are the inhibiting factors for the implementation of the prepaid electricity sale and purchase agreement between the customer and PT. PLN (Persero) Pekanbaru Area, Simpang Tiga District ? The research method used in this research is empirical legal research, while the nature of this research is descriptive. The population in this study consisted of customer service supervisors at PT PLN (Persero) Pekanbaru Area Simpang Tiga and prepaid electricity customers. The sample in this study amounted to 100 people using a purposive sampling technique. The data collection tools used are questionnaires and interviews. From the results of the research that the author did, it is known that the implementation of the prepaid electricity sale and purchase agreement between the customer and PT. PLN (Persero) Area Pekanbaru Rayon Simpang Tiga seen from the contents of the SPJBTL agreement, there are several articles that contradict Law Number 08 of 1999 concerning Consumer Protection. Those articles are article 6 paragraph (1) which. contrary to Article 18 Paragraph (1) letter a and Article 9 paragraph (2) regarding the termination of the agreement which is contrary to Article 18 Paragraph (2) that business actors are prohibited from including standard clauses whose location or shape is difficult to see or cannot be read clearly, or whose expression is difficult to understand. Obstacles in the implementation of the prepaid electricity sale and purchase agreement between the customer and PT. PLN (Persero) Area Pekanbaru Rayon Simpang Tiga, namely the customer cannot make any prosecution, if the PT. PLN (Persero) does not fulfill the obligations according to the agreement and the sanctions in the agreement are only for the customer.
