Abstract

Legal certainty of land ownership for places of worship is realized through land registration in article 19 of the main agrarian law number 5 of 1960 and government regulation number 24 of 1977, as it is known from the registration, it is hoped that the land owner will be able to provide legal certainty, information to the parties. interested parties and the implementation of an orderly land administration. In fact, not all lands belonging to places of worship have been registered by the management to realize legal certainty The formulation of the problem in this research is, how is the legal certainty of land ownership of places of worship that does not have proof of ownership, the factors that cause legal certainty of land ownership of places of worship cannot be realized and the efforts of administrators of houses of worship to realize legal certainty of land ownership of places of worship in Tambang District. The method used in terms of its type is survey, while its character is classified as descriptive to describe the main problem being researched by respondents. The research consisted of 20 mosque administrators, the Ministry of Religion of Kampar Regency and the Head of the Kampar Regency Land Office and the Head of Tambang Sub-district each. The data used are primary and secondary data using questionnaires and interviews. Data analysis was carried out by inductive method. Legal certainty for the land of places of worship should be realized through land registration, but based on the results of the research it has not been realized so that there is still land belonging to houses of worship in the mining sub-district that does not have a certificate because it is not registered. for those who have certificates, only 2 houses of worship, the rest only have proof of SKGR, SKT and Waqf Deed, as is also influenced by the ignorance of the management and the absence of the necessary costs, as the efforts made by the management of houses of worship to realize legal certainty are the absence of efforts from the management it's just that the management hopes that the government will disseminate information to all houses of worship about the importance of proof of ownership of the land. besides that, it is also necessary to take part in the Complete Systematic Land Registration (PTSL) program.
