Abstract

Sales and purchases are contracts made based on statements (ijab) and requests (qabul) which are stated clearly and verbally or with the same meaning. The statement can be made in direct, letter or news. Birds are one of the most interesting kinds of animals to keep as pets. This study is conducted at the Palapa Market, Pekanbaru city. The problem formulation of this study is how is the practice of buying and selling lovebirds at the palapa market in Pekanbaru city and how is the practice of buying and selling lovebirds in the perspective of Islamic Economics. This study aims to investigate the practice of buying and selling lovebirds at the Palapa market in Pekanbaru city and to find out the practice of buying and selling lovebirds in the perspective of Islamic Economics. The terms and conditions in buying and selling are the contract, the seller, the buyer, the goods being traded, and the price. The type of this study is field research with a qualitative descriptive method. The data sources of this study are primary data and secondary data. The population consists of 50 traders and the sample consists of 9 traders and 3 buyers. The data collection techniques used are observation, documentation, and interviews. Then, the data are analyzed by using qualitative description phases, e.g. data reduction, data display, and conclusion drawing. Based on the results of interviews that the author did at the Palapa market, the transaction practices conducted by the traders and buyers are in terms of contracts that are carried out orally and consensual between the two parties. However, there is one condition of the buying and selling practice which is not fulfilled in the rules of Islamic Economics, i.e. buying and selling in the form of not knowing clearly the object of the goods. In other words, it is found that the practice of buying and selling lovebirds at the palapa market contains an element of gharar according to Islamic economics, because the traders categorize the price of lovebirds based on the genders by identifying the size of birds body shapes.
