Abstract

Scholarships are a form of award given to individuals in order to continue their education to a higher level. The award can be in the form of certain access to an agency or an award in the form of financial assistance to help students, the form can be in the form of lodging, study materials including tuition fees, or only tuition fees, it can also be only in the form of a percentage of tuition fees, scholarships are given based on terms and conditions.convinced. However, usually this is accompanied by an agreement or agreement (contract) which states to be able to devote or carry out a higher education service bond, then in this capacity there has been a default in the agreement to devote the bond. The problem in this thesis is how to resolve the default dispute, as well as how the judge's consideration in the decision on Case Number: 643/Pdt.G/2020/PN Prp regarding the settlement of the default dispute (broken promise) granting scholarships. The nature of the research used in the completion of this thesis is a descriptive analysis that leads to normative juridical law research, namely finding the process of occurrence and the process of working the law through legal materials that are theoretical. The results of the research and discussion explain that dispute resolution through litigation at the Pasir Pengaraian District Court is in accordance with the provisions of absolute competence regulated in Law no. 3 of 2006 Article 49. The legal basis used as consideration for the Panel of Judges in deciding cases in general is in accordance with applicable legal provisions, but there are still some things that in the author's opinion are less relevant, namely regarding the decision to award scholarships to the defendants and there are inconsistencies claim for compensation in the posita and petitum filed by the plaintiff.
