Abstract

The number of cases of termination of employment that are decided/performed by the company before being reported to the Department of Manpower, and the existence of termination of employment that is carried out unilaterally by the company without going through the procedures stipulated in the provisions of the Manpower Act No: 13 of 2003 concerning employment and lack of knowledge/ workers/laborers' insight into the relationship and working conditions regulated in the Manpower Act No: 13 of 2003 concerning Manpower which can directly harm workers/labourers. In terminating the employment relationship, PT. Ramajaya Prakmukti is not appropriate to provide severance pay to workers who have been laid off and in addition, workers have not been included in Jamsostek insurance, so that when workers are terminated, they do not receive insurance from PT. Social Security. As for the reason PT. Ramajaya Prakmukti does not include its employees at PT. Jamsostek because of the minimum salary each employee earns. Based on the background of the problem that the authors describe above, the authors first determine how the obligation to provide severance pay as compensation for termination of employment layoffs for laid-off employees at PT. Ramajaya Prakmukti and Is Giving Severance Pay To Employees of PT. Ramajaya Prakmukti who has been laid off has complied with the applicable rules. This writing, when viewed from the type of research, can be grouped into Sociological research conducted by survey, namely research directly to the research location using data collection tools in the form of interviews. Meanwhile, if viewed from its nature, this writing is descriptive, which means the research is intended to provide a detailed, clear and systematic description of the main research problems. Obligation to Provide Severance Pay as Compensation for Termination of Layoffs for Lay Off Employees at PT. Ramajaya Prakmukti that PT. Ramajaya Prakmukti is obliged to provide severance pay to 15 of its employees whose employment has been terminated, without exception, because these are rights that must be received by workers whose employment has been terminated by the company. Giving Severance Pay to Employees of PT. Ramajaya Prakmukti who was laid off has complied with the applicable rules that the implementation of Termination of Employment carried out by the Company PT. Ramajaya Prakmukti to its employees resulted in the provision of severance pay to workers, but the severance pay was not in accordance with the expectations of the workers, because the severance pay received was not in accordance with the provisions of the applicable laws.
