Abstract

ABSTRACT Law enforcement carried out by the Civil Service Police Unit in imposing fine sanctions on pubs that violate Operational Hours in Pekanbaru City have not been effective and efficient because there are still many pub places that violate the rules and are not enthusiastic about Regional Regulation Number 3 of 2002 concerning Public. Entertainment and there are still rules that are violated by these entertainment venues. This study has 2 problem formulations, namely: How is the law enforcement of the Pekanbaru civil service police against criminal penalties for pub fines for violating operating hours and what are the obstacles in law enforcement carried out by the civil service police unit against pubs that violate operating hours. The method used to answer the aforementioned problems is by researching the law of observation (survey) by conducting field research at the Civil Service Police Unit Office of Pekanbaru City and public entertainment places, especially Pubs in Pekanbaru City. The data used in this thesis are obtained through interviews, literature books, legal journals, theses, laws and legal dictionaries. The entire data that has been obtained is then analyzed quantitatively and then concluded through the deductive method. The results of the research show that law enforcement against violators of pub operating hours by the Pekanbaru City Civil Service Police Unit is aimed at finding out the violations committed as well as the fine sanctions imposed on public entertainment venues, especially pubs. In law enforcement against the penalty for operating hours of pub places by the Civil Service Police Unit of Pekanbaru City, the Civil Service Police Unit has not implemented it properly because of the many problems that often occur, one of which is in the penalty sanction in this fine sanction is contradictory because if a violation occurs Satpol PP operating hours often receive bribes from the pub owner so that the Satpol PP does not interfere with the comfort of customers in Pekanbaru City. Obstacles in carrying out law enforcement by the Civil Service Police Unit against pubs that violate operational hours include the legal factor itself, the Perda cannot be used as a benchmark anymore in today's developments, the Law Enforcement Apparatus Factors, namely the Lack of Civil Servant Investigators of Satpol PP Pekanbaru. , Lack of Coordination with the National Police, Lack of Quality Resources for Civil Service Investigators of Satpol PP and Acceptance of bribes by law enforcement officials. The facilities and infrastructure factors are not sufficient to support the implementation of their duties and functions, this is not in accordance with the number of Satpol PP members in carrying out their duties as enforcers of the Pekanbaru City Regional Regulation.
