Abstract

ABSTRACT This research is motivated by the emergence of buying and selling gold online with a non-cash payment system and with a minimum price of IDR 5,000 at Tokopedia Emas, where in practice after the buyer saves gold in installments the buyer does not get gold in physical form (gold bullion) but can only get sell it and withdraw it in the form of money through the Tokopedia balance. Meanwhile, if we look at the terms of the harmonious agreement, there must be a contract object and it can be handed over. The problem in this research is how is the implementation of buying and selling gold on the online buying and selling site on Tokopedia, and what is the view of Islamic law on buying and selling gold electronically (online) on Tokopedia The research method used in this research is a type of normative legal research. The stages of data processing in this study are organizing, editing and analyzing. In writing this research, the data and information related to the online gold buying and selling transactions that have been obtained by researchers are first analyzed in the form of regular and effective sentences. The result of this research is that the implementation of buying and selling gold in the online buying and selling site at Tokopedia Emas is logging in to the Tokopedia application, then for the order process or selling the contents of the amount of gold to be bought or sold in grams or rupiah, then choose the payment method for the contract and payment Finally, the process of adding or withdrawing the gold balance will be verified automatically in the Tokopedia balance and for disbursing the gold balance it will enter the Bank account. The scholars who prohibit the opinion that gold and silver are tsaman (price, means of payment and money), which should not be exchanged tough or in cash, because it causes usury. Meanwhile, scholars who allow the opinion that the sale and purchase of gold can be done both in cash and in cash as long as they are not meant as a tsaman (price, means of payment and money), but sil'ah (goods). Buying and selling gold online is included in the sale and purchase of greetings, that is, the goods being traded will be accepted with advance or advance payment (or payment in advance of the goods).
