Abstract

High inheritance is property that is already owned by the family. The right to use the property has been passed down from generation to generation so that the recipient of this property has been blurred and its origins cannot be known. Basically, traditionally, high inheritance assets cannot be pawned, but if the customary holders or the indigenous people want to mortgage them, then there are several conditions that must be fulfilled. One form of shift from the foundation of customary law itself is one of which is the implementation of the pusako property land pawning, which basically means that the pusako property cannot be pawned, let alone for sale. The research method is observational research, namely by surveying or visiting directly to the research location using data collection tools, namely interviews. Meanwhile, it is descriptive in nature, that is, research is intended to provide a detailed, clear and systematic description of the main research problems The results showed that the position of high inheritance and its transition in the customary law community in Pulau Binjai Village, Kuantan Mudik District, Kuantan Singingi Regency is high inheritance which is the property of all members of the clan and is obtained from generation to generation through the maternal lineage, but there are still high pusako assets. whose position has been transferred to another person who is not in accordance with the transitional system, that is, there is a mortgage on the property, but the implementation is not carried out according to the stipulated terms and conditions, that is, there is no consensus or agreement with all the people. This is because the high pusako property holders dare to pawn the pusako without the knowledge of all the people who have rights to the pusako property, even though the members of the clan have use rights and are usually managed by the head of inheritance, and the status of customary rights over inheritance is high in its use and transfer in the village Binjai Island, Kuantan Mudik District, Kuantan Singingi Regency is high heirloom property not private property that can be traded or transferred by one person to another, high heirloom property is the property of a tribe or clan consisting of large family kinship units in a regulated tribe or clan. its use for sisters and nieces.
