Abstract

According to the community, this PETI activity appeared around 2007. Since the emergence of the PETI, the banks of the Kuantan river have collapsed at a number of points and are gradually being damaged, the river water that was originally clear has started to turn cloudy, various riverbed ecosystems have disappeared, and various types of fish and ecosystems have been lost. another river. The pollution and damage caused by PETI is increasing from year to year and continues to this day. PETI is a threat to the wider community because miners use mercury (mercury) to manage the mining products they get. As we know that this mercury if consumed by the body can cause various diseases and lead to death. The formulation of the problem in this study is what are the factors behind the criminal act of carrying out gold mining without a permit (PETI) in the jurisdiction of the Kuantan Tengah Police, how are the police efforts in tackling the crime of carrying out gold mining without a permit (PETI) in the jurisdiction of the Kuantan Tengah Police, and what are the inhibiting factors for the police in tackling the crime of carrying out gold mining without a permit (PETI) in the jurisdiction of the Kuantan Tengah Police. The author chose the method of sociological legal research, namely research conducted by means of Observational Research, namely by means of surveys or directly to the field to the research location by using data collection tools in the form of observations and interviews. The results of the study show that the factors behind the criminal act of carrying out gold mining without a permit (PETI) in the jurisdiction of the Kuantan Tengah Police are: (a) Economic factors, (b) Socio-cultural factors, (c) Policy factors, (d) The existence of investors . Police efforts in tackling the crime of illegally mining gold (PETI) in the jurisdiction of the Kuantan Tengah Police are pre-emptive, preventive and repressive efforts. The inhibiting factors for the police in tackling the crime of carrying out gold mining without a permit (PETI) in the jurisdiction of the Kuantan Tengah Police are: (a) The legal awareness of the community is decreasing, (b) The perpetrators of gold mining without a permit are backed up by unscrupulous elements. irresponsible individuals, (c) Gold mining actors without a permit run away, (d) Lack of community role in assisting the police, (e) Lack of coordination between the police and the mining service. (f) Lack of facilities, facilities and equipment in tackling the crime of carrying out gold mining without a permit.
