Abstract

ABSTRACT The background is the problem of implementing the cooperation agreement for the construction of luxury housing springhill in Pekanbaru between the first party / PT. Graha Citra Melayu with the second party / PT. BerkatKurnia MitraAbadi is where the parties enter into an agreement that has been agreed upon by the two parties as stated in the Agreement Deed, where each party who carries out the Agreement has Rights and Obligations or achievements, then the Rights and Obligations bound to the parties must be carried out in accordance with the contents of the agreement and the parties. the party that entered into the agreement must be based on principles, regulations and laws, especially regarding the law of the agreement. The implementation of the springhill luxury housing development cooperation agreement has obstacles and problems from the implementation of the housing development cooperation agreement, the existence of rights and obligations that are not carried out properly or in default so that obstruction of the implementation of the agreement results in the loss of a party involved in the cooperation agreement. The purpose of this study was to determine the implementation of the luxury housing development cooperation agreement between PT. Graha Citra Melayu and PT. BerkatKurnia MitraAbadi in Pekanbaru and to find out what are the inhibiting factors in the implementation of the luxury housing development cooperation agreement between PT. Graha Citra Melayu and PT. BerkatKurnia MitraAbadi in Pekanbaru. This research is a qualitative descriptive study. Research location jl. Pomegranate in Pekanbaru. The types of data used include primary and secondary data. With data collection techniques used are interviews and literature study in the form of books, laws and regulations, documents and so on. Data analysis using qualitative data analysis and deductive conclusion. Based on the results of the research, it was found that the implementation of the cooperation agreement did not go as it should, the second party did not carry out its obligations that had been promised to the first party, based on the research results of the cooperation agreement in the implementation of the cooperation agreement for the construction of luxury housing in Springhill experiencing obstacles in its implementation, where the implementation of the cooperation agreement not as it should be because there was a problem with credit to the bank which resulted in the housing construction not being carried out, so that the rights of the first party as the owner of the land were not fulfilled.
