Abstract

An agreement is an act by which one or more people bind themselves and have a legal relationship in an agreement, which will give rise to the rights and obligations of each party, especially regarding agreements in the activities of procuring coffee seeds and organic fertilizers for the expansion of the Liberica coffee plant. The main problem in this study is how the implementation of the agreement between CV. Calvin Zuraya Lawita with the Department of Plantation and Horticulture in the procurement of coffee seeds and organic fertilizers for the expansion of liberica coffee plants in the Meranti Islands Regency and what are the obstacles in implementing the agreement between CV. Calvin Zuraya Lawita with the Department of Plantation and Horticulture in the procurement of coffee seeds and organic fertilizers for the expansion of liberica coffee plants in the Meranti Islands Regency. The research method used is Observational Research by means of a survey, namely interviews as a data collection tool. This research is descriptive analytical, which provides a clear and detailed description of an incident that occurred. From the results of the study it can be concluded that the implementation of the agreement between CV. Calvin Zuraya Lawita with the Department of Plantation and Horticulture in the procurement of coffee seeds and organic fertilizers for the expansion of the Liberika coffee plant, which is not in accordance with the Procurement Work Package Agreement, the implementation period is 45 (forty five) calendar days. The agreed deadline for the issuance of SPP by PPK for payment of installment bills is 7 (seven) calendar days from the date of receipt of the invoice and the completeness of supporting documents that are not disputed. And the problems with the POKJA auction are Evaluation for coffee requirements, bidders must attach a certificate of seed quality (special requirements), while the evaluation of the formulation of the POKJA auction does not see an expiration period for seed quality, the certificate attached to the auction participant has expired and PP No. 16 of 2018 concerning Government Procurement of Goods/Services must be updated in accordance with developments. It should be made in a (special) work reference framework but in reality it has been changed to a general tender. And it is not in accordance with the procurement of coffee seeds and the price is played for certified coffee seeds. Efforts to resolve the problem prioritize good faith between the two parties.
