Abstract

ABSTRACT Dispute resolution which is commonly used for the disputing parties, one way is done through mediation, this is a problem solving method with the aim of reaching the agreement of the disputing parties in accordance with what is expected without any harmed party. PT. Mitra Hutani Jaya is located in Pelalawan Regency, precisely in Teluk Meranti District, in carrying out its activities in the form of utilizing timber forest products in plantation forests, there have been disputes with some people who have cleared land since 1986. mediation is used as a way to get peace over a land dispute was not reached, so to seek the issuance of a business license from the company, a meeting was held which resulted in an agreement. The main problem of the research is how to resolve land disputes between PT. Mitra Hutani Jaya with the community through mediation in Teluk Meranti District, Pelalawan Regency, and What are the obstacles in resolving land disputes between PT. Mitra Hutani Jaya with the community through mediation in Teluk Meranti District, Pelalawan Regency. The research method is observational research or survey, research carried out directly to the research location that has been determined to obtain information that supports the author's research. while its nature is descriptive, that is, where the author describes in a clear and detailed manner the problems to be studied. The results of the study that the settlement of land disputes between PT. Mitra Hutani Jaya with the community through mediation in Teluk Meranti Subdistrict, Pelalawan Regency is not working due to a disagreement in the agreement even though mediation has been carried out twice. The first mediation failed because there was a discrepancy in the price of compensation charged to the company so that the company refused mediation, then the mediation of the two communities refused because they felt that the Village Apparatus who became the mediator supported the company more than the community, and Obstacles in resolving land disputes between PT. Mitra Hutani Jaya with the community through mediation in Teluk Meranti District, Pelalawan Regency is that there is no agreement to resolve disputes, especially in terms of compensation, the village government or village officials have tried to resolve the dispute but cannot be resolved either because it is difficult to bridge or negotiate the company with the community, and the community did not approve of the compensation provided by the company, because it was not in accordance with the wishes of the community.
