Abstract

ABSTRACT The implementation of the consumer credit insurance closing agreement begins with a cooperation agreement between the insurance company and the bank. In the cooperation agreement, the bank acts as the party that distributes consumer credit, which in this case the bank is also a regional-owned enterprise (BUMD) which in the agreement is the insured party. To secure the operational activities of the insured in the distribution of funds for consumer credit from the risk of loss caused by the default of the recipient of the credit facility (debtor). In this case the insured intends to establish a mechanism for managing consumer credit insurance. The main problem in this research is, the Juridical Review of the Consumer Credit Insurance Coverage Agreement Between Pt. Bpd Riau Kepri With Pt. Asuransi Asei Indonesia, and How Legal Protection Forms in a Cooperation Agreement for Closing Consumer Credit Insurance between the Parties. Judging from the type, this research is included in the normative research group. That is research based on primary legal materials, secondary data and tertiary legal materials. Primary data is the main data obtained by researchers through laws and regulations. The results of this study explain that this agreement is made based on the legal basis that already exists in the Civil Code contained in article 1316 of the Civil Code which contains "even so it is allowed to bear or guarantee a third party, by promising that this person will do something, without prejudice to the claim for payment of compensation against those who have borne the third party or who have promised, to order the third party to strengthen something, if this party fulfills its engagement� then this is the basis for the formation of the agreement between the parties.
