Abstract
Since digital technology based on computer electrical signals or internet-based technology is increasingly popular throughout the world, and the development of internet-based technology has had a significant impact, both positive and negative. The phenomenon of spreading fake news (hoax) is currently spreading more and more. In this current era, social media occupies the top position in spreadingnews hoax, hoaxes are spread repeatedly so as to form public opinion that the news is true. This phenomenon uses criminological theory with a criminological review, such as the chronology and views of a criminologist on the imposition of a crime that is enforced, and is explained in the ITE law article 28 paragraphs (1) and (2), and the Criminal Code Article 14 paragraph (1) and ( 2). This fake news or hoax itself has a very negative impact. Both the victim whose good name is defamed and the perpetrator (who is caught) will face imprisonment and dangerous mental pressure.
