Abstract

ABSTRACT Shares are evidence (ownership) of a company, the company issues shares as a way to get funds from the investor community. Companies that want to get capital can trade their shares in the capital market, but the reality of the game of shares by investors is that there is a way that is considered fraudulent by the author in the process of seeking profit through buying and selling shares in the capital market, which is not in accordance with Islamic law which in the Al-Quran has given clear guidelines. It is clear that in conducting buying and selling transactions, it must pay attention to the halal and haram elements, which are contained in the QS. An-Nisa Verse 29 . The formulation of the problem in this study is how to protect and secure transactions for users and service providers or stock exchange services and how according to the perspective of Islamic law regarding online stock buying and selling transactions as a modern investment. This research method is library research, where the data and data sources are obtained from a review of books or literatures that discuss or relate to the problems studied. The results obtained in this study are in Law Number 8 of 1995 concerning the capital market Chapter IX articles 90-99 categorize several characteristics of crimes or violations in online stock trading transactions in the capital market in three categories, namely fraud, market manipulation and human trafficking. in. Therefore, some sanctions are given in order to maintain the security of transactions in the capital market and from the perspective of Islamic law, conducting online stock buying and selling transactions if investing in companies that do not conflict with Islamic law is permissible, as long as stock investment (buying and selling shares) does not commit fraud. can harm other investors and fulfill the terms and conditions in conducting the online share buying and selling transactions.
