Abstract

ABSTRACT One of the phenomena that occur in the people of Kampung Pulau Seberang Village is the distribution of inheritance before the heirs die, by collecting all the heirs. This distribution will be attended by someone who is considered a parent or elder in the family or in the community. Giving wealth after the heir dies is a common process in every inheritance law, but giving an inheritance before the heir dies "during his life" is a thing that he is not accustomed to in general inheritance law. The formulation of the problem in this research is how the implementation of community customary inheritance in Kampung Pulau Seberang Village, Indragiri Hulu Regency and how the views of Islamic Law on the practice of inheritance for the people of Kampung Pulau Seberang Village, Indragiri Hulu Regency. The research method used in this research is a survey, while the nature of this research is descriptive. The population in this study consisted of community leaders, village heads and all heirs who carried out the distribution of inheritance in Kampung Pulau Seberang Village during 2018. The sample in this study was determined by 23 people, with purposive sampling technique. Data collection tools used are questionnaires and interviews. From the results of the research that the author did, it is known that the implementation of Community Inheritance in Kampung Pulau Seberang Village, Indragiri Hulu Regency is carried out by means of grants and will grants, this is done to anticipate disputes between heirs (his children) and in order to achieve the benefit , the division of inheritance between men and women is based on the discretion of the parents who do not distinguish between sons and daughters. This division is carried out to ensure justice and maintain family harmony and integrity. The view of Islamic law on the practice of inheritance of the village community of Pulau Seberang Village, Indragiri Hulu Regency is not an inheritance, but as a gift from parents and the ownership status belongs to the heir and cannot be returned to the heir.
