Abstract

Hand arrest operation (OTT) is one of the efforts conducted in handling the corruption cases. Rampant catching lately done by KPK is known by the term Operation Catch hand or OTT gave rise to polemic whether legitimate or illegitimate. Parties who consider that OTT is illegal basing on arguing that the absence of a Capture Operation term of hands in the code of criminal procedure, only Caught hand. The difference is then inferred that OTT is illegal. This research aims to explain juridical analysis OTT which is conducted to corruption eradication Commission in criminal justice system of Indonesia. The researc method used is normative legal research method with doing study of library materialsto collect secondary data. Normative legal research is doing with researching library materials which is secondary data. From analysis that can be understood then OTT corruption eradication Commission in relation with hand arrest in criminal justice system that 119 article paragraph 1 and 19 article paragraph 1 above is legal basis hand arrest operation is doing by corruption eradication Commission which is considered illegal and then looked at that hand arrest operation is different than hand arrest. Which also conducted OTT related to illegal levies. However, the term OTT is not mentioned on the legal provisions of the corruption case handling procedures. The provisions on the procedural law only regulated the arrest and hand arrest. So that, in the future it is necessary to regulate specific arrangements about hand arrest operations and their technical implementation so as not to cause abuse of authority by the Corruption Eradication Commission in hand arrest operations.
