Abstract

This research is motivated by the problem of the frequent occurrence of online buying and selling agreements made by minors. The weakness of this transaction is that there is no stipulation regarding the age limit for the parties who enter into an agreement in buying and selling online. The purpose of this study is to determine the implications of online buying and selling carried out by minors and the legal position of buying and selling online, if both parties or one of them is a minor. The method used is normative juridical, using descriptive analytical specifications, through literature study at the Islamic University of Riau and then analyzed qualitatively. The results of this study indicate that if it is associated with contract law, the provisions in online buying and selling must be subject to the Civil Code, namely if the parties are not legally competent, the agreement can be canceled However, until now there has not been a single legal rule that specifically regulates the age limit for a child to be allowed to buy and sell online. However, if in the future a problem arises, the legal force of the agreement is weak because it does not meet the legal requirements of the agreement in Article 1320 of the Civil Code.
