Abstract

ABSTRACT Pekanbaru is the largest economic center on the island of Sumatra, has an international airport and inter-provincial bus terminal and has two Siak River ports, namely Pelita Pantai and Sungai Duku, which make Pekanbaru a strategic city for trade routes. The Duku River port is a port that connects the city of Pekanbaru with the Meranti Islands Regency where the port is a place for passengers to get up and down between Pekanbaru, Selatpanjang and vice versa, has a fairly large parking area managed by the government (transportation service). Parking management certainly understands the applicable regulations, but it is not in accordance with the reality, parking managers (transportation services) do not understand the prohibition of the inclusion of the exoneration clause. Whereas the exoneration clause is clearly contrary to Law no. 8 of 1999 concerning Consumer Protection. The lack of security for consumer vehicles is evidenced by the loss of consumer goods in the parking area and the ease with which people leave using vehicles without a parking ticket inspection which is likely to make it easier for people to commit theft. a ticket containing an exoneration clause in the form of freedom of contract which means that everyone is free to enter into an agreement without conflicting with applicable law. However, the contents of the exoneration clause itself are very cornering one of the parties. This act is an attempt to benefit a certain party because of the ignorance of the exoneration clause, in a way that is contrary to the law. In conducting this research, the authors formulated the main problems including how to implement the parking ticket standard clause on vehicle loss at the Duku River port of Pekanbaru Riau and what are the obstacles in implementing the parking ticket standard clause on vehicle loss at Duku River port, Pekanbaru Riau. The research method that the author uses in this research is Observational Research by means of a survey, namely the research is carried out directly to the research location in order to obtain information and data related to this research by conducting interviews as a tool to collect data. Based on the results of research regarding the Implementation of the Implementation of the Standard Parking Ticket Clause Against Vehicle Loss at the Duku River Port, Pekanbaru Riau, it is not in accordance with Law Number 8 of 1999 concerning Consumer Protection that the parking manager or Duku River terminal is not responsible for the loss of vehicles deposited by consumers in the port duku river. but the terminal manager provides a solution to the loss experienced by consumers.
