Abstract

ABSTRACT In Pantai Raja Kampar Village in terms of marriage, it adheres to an exogamous marriage system in which Pantai Raja Kampar Village requires its people to marry people outside of their tribe and marrying people from their own tribe is prohibited or in customary terms known as ethnic marriage. Ethnic marriages are prohibited because the indigenous people of Pantai Raja Kampar Village view ethnic marriages as marriages of one family or milk, which means that there is still a family relationship or blood relationship between one another. However, there are still people who carry out ethnic marriages (endogamy). The formulation of the problem in this study are: a) How is the implementation of endogamous marriage according to customary law in Kenagarian Perhentian Raja, Pantai Raja Kampar Village?, b) How is customary law enforcement for endogamous marriage according to customary law in Kenagarian Perhentian Raja, Pantai Raja Kampar Village? The type and nature of this research is classified as observational research. This research goes directly to the field through observation and interviews. The nature of this research is descriptive which explains in full about the implementation of endogamous marriage according to customary law in Kenagarian Perhentian Raja, Pantai Raja Kampar Village. The result of this research is that the implementation of endogamous marriage according to customary law in Kenagarian Perhentian Raja, Pantai Raja Kampar Village, is prohibited/should not be carried out in Perhentian Raja Kenagarian Raja Kampar Beach Village. Endogamous marriage is a marriage that is not prohibited by religious law and state law, therefore if the community still does not heed the customary law that has been applied from generation to generation, then the endogamous marriage may be carried out as long as it is not carried out in Kenagarian Perhentian Raja Desa Pantai Raja Kampar and does not violate provisions of religious law and state law. The enforcement of customary law for endogamous marriages according to customary law in Kenagarian Perhentian Raja, Pantai Raja Kampar Village, is to impose sanctions for violators who carry out endogamous marriages by being excluded or not recognized by the tribe, do not have a mamak and are not considered nephews by the tribe. Every tribal activity will not be involved or included, as well as if the violator carries out an activity, the tribal community will not attend or participate.
