Abstract

Based on Law No. 1 of 1974 or amendments to Law No. 16 of 2019 concerning marriage to the rules in its implementation that the law strictly prohibits the marriage of minors. A review of the problems in the Talang Mamak tribal community, has violated several laws. The marriage of minors is contrary to Law Number 16 of 2019 which states that the minimum age of the bride is 19 years. The main problems in the researcher are: First, how is the implementation of underage marriage in the Talang Mamak Tribe in Talang Sei Limau Village, Rakit Kulim District, Indragiri Hulu Regency and Second, what are the factors for the implementation of underage marriage in the Talang Mamak Tribe in Talang Sei Limau Village, Rakit Kulim Subdistrict, Indragiri Hulu Regency. The type of research method that the researcher uses is sociological research, namely empirical research, namely the type of research carried out by means of observational research, namely by means of surveys or directly to the location of research and the nature of writing is descriptive analysis (analytical). Descriptive analysis research is a study in which the author intends to provide a complete picture and describe the facts and objects under study. Regarding the results of the research, the authors found: First, there are no rules that say that it is permissible to marry under the age of 19 in the Talang Mamak tribe, as well as positive law in Indonesia, which according to the law concerning the age limit for marriage in Indonesia, is clearly regulated. in Law No. 16 of 2019 amendments to Law No. 1 of 1974 concerning Marriage in article 7 with the following formulation: Marriage is only permitted if a man and a woman have reached the age of 19 (nineteen) years. Second, marriage at a young age or underage marriage has several factors that influence it, namely the Fear of Parents, Economic Factors, Low Education Factors, and environmental factors.
