Abstract

Land Deed Making Officials (PPAT) are officials who are authorized to make deeds rather than agreements that intend to transfer land rights, but there are many violations committed by PPAT to carrying out their roles that are not in accordance with the rules, for example in the issuance of Ownership Certificates (SHM) there are many PPAT in the Riau region, one of which is PPAT in the Indragiri Hilir Regency. In connection with this the author conducted research with the formulation of the problem related to how the legal sanctions against Land Deed Maker Officials (PPAT) who are wrong in carrying out the profession as PPAT in Indragiri Hilir Regency and also How is the responsibility of Land Deed Maker Officials (PPAT) in the process of transfer of names in Indragiri Hilir Regency. The research method used is sociological or empirical which is carried out by means of a survey, in which the authors go directly to the field by conducting direct interviews at one of the PPATs in Indragiri Hilir Regency. While the nature of this research is descriptive, that is, it provides an overview and describes the problem under study, namely how the PPAT's responsibilities are related to the transfer of names to the issuance of certificates of property rights (SHM). The results of this study indicate that those who are wrong in carrying out their profession as PPATs in Indragiri Hilir Regency are threatened if their use can cause losses, due to forgery of letters, with a maximum imprisonment of six years, and Liability (PPAT) in the Transfer of Names Process in Indragiri Hilir Regency is PPAT Liability in a civil manner as well as the imposition of criminal sanctions. The imposition of criminal sanctions can be carried out as long as the limits are determined by the legislation related to PPAT, PJPPAT; The PPAT code of ethics, and the formulation contained in the Criminal Code (KUHP) were violated.
