Abstract

People in everyday life will not be separated from doing a legal act, one of which is by way of a contract or agreement that can be accounted for to all parties and one example of an agreement is a lease agreement. An agreement is an agreement that has been obtained by both parties. Basically, an agreement has been reached between the two who promise to carry out the agreement in accordance with the contents of the agreement, and what will happen between the two to be achieved. The phenomenon that occurs is that there are still violations of the previously agreed agreement. The problems studied in this study are: 1) How is the settlement of default by the tenant in the implementation of the lease of four-wheeled vehicles at CV. Familia South Zone in Pekanbaru City. 2) What are the obstacles in the settlement of default in the implementation of four-wheeled vehicle rental at CV. Familia South Zone in Pekanbaru City. The type of this research is included in the field research called sociological legal research, where in this study the author directly examines the research location by using data collection tools in the form of observations and interviews. The nature of this research is descriptive meaning a study that intends to provide a clear description of an event or fact that occurs systematically on the four-wheeled vehicle rental agreement carried out by the tenant between the Rent Car Zones in Pekanbaru City. Based on the results of this study indicate that the settlement of default by the tenant in the implementation of the lease of four-wheeled vehicles at CV. The Familia South Zone in Pekanbaru City uses alternative dispute resolution through non-litigation channels, namely using the negotiation route. Where this negotiation route prioritizes a sense of family and deliberation between the two disputing parties. Obstacles in the settlement of default by the tenant in the implementation of a four-wheeled vehicle lease at CV. The Familia South Zone in Pekanbaru City are: 1) There is no good faith from the tenant, 2) The tenant who delays payment, 3) Their Dissatisfaction 4) Unforeseen Conditions.
