Abstract

Indigenous Peoples' Customary Rights are sometimes set aside with other interests regardless of the spiritual value of a piece of land that exists in the community's territory. The customary land dispute in Sitiung Village District, Dharmasraya Regency, West Sumatra Province, was due to the recognition of an individual named Maharani who had made a certificate for the customary land issued by BPN Dharmasraya without the knowledge of Ninik Mamak and the datuk Rajo Malelo indigenous people. The main problems of this study are dispute resolution of granting property rights on customary land in Dharmasraya regency and inhibiting factors for resolving disputes over granting property rights on customary land in Dharmasraya regency. The research method used in this study is to use Empirical legal research, with the technique of data collection, namely by interviews. Judging from its nature, this research includes descriptive research, namely research that provides a detailed and clear picture of the main problem of the research. The result of the discussion of this study is that the Implementation of Dispute Settlement of Granting Property Rights on Customary Land in Dharmasraya Regency Settlement has been carried out by mediation, and in the end the dispute over the customary land of the people in nagari Sitiung is still not completed because one of the parties is not present in the mediation process and the inhibiting factor in the Settlement of Disputes over The Granting of Property Rights on Customary Land in Dharmasraya Regency is first due to Absence the parties to the dispute, either one or both sides, are an obstacle in itself. And the absence of good faith from any of the parties to the dispute.
