Abstract

Regarding the implementation of the rental of a shop house (ruko) verbally very risky to the recipient of the lease, because if in the future the occurrence of fire and or damage to the shop, who is the responsibility. Both parties should agree before making an agreement To rent out 1 (one) or more shophouse units, you must make an agreement in writing. Aiming in the future, if a problem occurs, it will reduce problems between the two parties. The reality of ineffectiveness law related to the existence of communities in the District of Siak Hulu, Kampar Regency who entered into a verbal shop rental agreement which has various effects. The impact is the absence of legal certainty of the verbal rental agreement for shophouses. The main problems are 1) how is the legal protection against shop house tenants (Ruko) verbally in Siak Hulu District, Kabupaten Kampar and 2) how to resolve the dispute that occurred between landlord and tenant. This type of research is by means of a survey, research that takes sample of the population using interview data collection tools tree. The nature of descriptive research is to describe the state of the subject or the object of research at the present time based on the facts that appear as where it is. Based on the understanding of the community in entering into a lease agreement rent, still don't understand because there are still many people wrong defines how the lease agreement is written orally and in writing. As well as Many also do not know how the rights and obligations of the parties in accordance with the applicable regulations in the Civil Code. Frequent problems This happens, one of which is due to the lack of understanding of the community itself. Settlement of disputes between owners and tenants basically can be qualified as a peaceful dispute resolution and adversarial dispute resolution. Peaceful dispute resolution better known as settlement by consensus. Temporary Adversial dispute resolution is better known as settlement disputes by third parties who are not involved in the dispute. Shape of peaceful dispute resolution is negotiation, mediation and conciliation, while the form of adversary settlement is through the courts or arbitration institution. Dispute resolution in accordance with the philosophy of the birth of e-commerce is through negotiation, mediation, conciliation nor arbitration.
