Abstract

Legal protection for children who work under age according to the labor law No. 13 of 2003 is motivated by the still occurrence of violations regarding the protection of children under the age according to the provisions set out in Articles 68 to 75 of the Manpower Act No. 13 of the Year 2003. Therefore, the authors conducted direct research with indicators in the form of protection obtained by child labor and the form of work agreements by minors. Based on the indicators above, the authors formulate the problem in this study, namely how is the legal protection for children who work under the age and what is the legal position of the work agreement made by the minor. The method in this study is Observational Research which is carried out by means of a survey, namely by direct research to the research location using data measuring tools in the form of interviews. This type of research is classified as normative-empirical research which functions to see whether the implementation of the law is in accordance with its application in the community. Based on the results of research conducted by the author that in providing legal protection to child labor, it is felt that it has not run optimally and there are still violations committed by the employer/employer against child labor where the provisions are not in accordance with the provisions that have been issued by law. Furthermore, regarding the legal position of work agreements carried out by minors, they are considered to be still valid as long as they are in accordance with the provisions of the Law on decency and public order.
