Abstract
In the procession of carrying out marriages for indigenous peoples in Kanagaraian Koto Mambang Sungai Durian there is a tradition called "bajapuik" (pick up), where men get something from women, such as "japuik money" and "lost money". "Japuik money" is different from the cost of the dowry or dowry. Because in this tradition, gifts made by the woman are given before the marriage contract, and the dowry is given after the marriage contract. However, it should be noted that men still give dowries to women, except during the event to visit the mother-in-law's house, men will also return "japuik money" in the form of goods whose value exceeds the "japuik money" given by the woman. In this study the authors have the main problems discussed as follows, How is the implementation of customary marriages in indigenous peoples in Kanagarian Koto Mambang Sungai Durian, Padang Pariaman Regency, What are the legal consequences in implementing customary marriages in indigenous peoples in Kanagarian Koto Mambang Sungai Durian, Padang Pariaman Regency and What are obstacles in the implementation of traditional marriages for indigenous peoples in Kanagarian Koto Mambang Sungai Durian, Padang Pariaman Regency. The research method that the author uses in this research is the type of research that is included in the research method of observation (observational research), the author collects data and looks for information about the activities that will be used as research objects. The results of the research that the authors obtained are that the implementation of customary marriages in indigenous peoples in Kanagarian Koto Mambang Sungai Durian, Padang Pariaman Regency requires conditions that must be met to make a proposal, Japuik money is also a requirement to make a proposal, Baimbang tando is one of the mandatory requirements in the Pariaman community, the conditions are Ring, Delivery, Umbrella and also usually the same as the conditions for wanting to do an engagement in other areas. If these conditions are not met, the family will meet or discuss again, and the reception will be the same as in other areas. other areas, if the reception is not held there is no problem because the reception is not mandatory, only as a notification that both parties are married. And . The legal consequence in the implementation of customary marriages in indigenous peoples in Kenagarian Koto Mambang Sungai Durian, Pariaman City, is that after the marriage the husband/wife has a role as a son-in-law. The male pariaman on the female side is called Sumando (son-in-law), the husband is welcome to stay at his wife's house because in Minangkabau society there is a matrilineal kinship system, but the husband has no role in the wife's property or the wife's family property, Minangkabau customs know what is called wealth High Inheritance and Low Inheritance. every implementation there must be such a thing as obstacles and obstacles in the implementation of traditional marriages in indigenous peoples in Kanagarian Koto Mambang Sungai Durian, Pariaman City, what often happens is when negotiating the amount of japuik money, therefore if a reception encounters a problem, the effort to resolve it is by way of deliberation between the ninik mamak and their extended family
