Abstract

A written contract or agreement is the basis for business actors or parties to carry out a prosecution if one of the parties does not carry out what has been agreed in a contract or agreement. As in the Road Reconstruction Preservation Supervision Agreement between the Directorate General of Highways, the Riau Province National Road Planning and Supervision Work Unit (P2jn) and PT. Indec Internusa, whether the parties have fulfilled their rights and responsibilities, in practice it often creates a problem where one party defaults on the contents of the work contract made by both parties. The main problem in this research is how is the implementation of the Road Reconstruction Preservation Supervision Agreement between the Directorate General of Highways, the National Road Planning and Supervision Work Unit (P2JN) of Riau Province and PT. Indec Internusa ? and the second is what are the obstacles in the implementation of the Road Reconstruction Preservation Supervision Agreement between the Directorate General of Highways, the Riau Province National Road Planning and Supervision Work Unit (P2JN) and PT. Indec Internusa ? The research method used is Sociological Empirical by means of survey research, meaning that a research conducted by the author directly goes down to the field to obtain information and data related to this author's research. Survey research is research that takes a sample from one population by using interviews as the main data collection tool. In the results of the research conducted by the author, the cooperation agreement made between the Directorate General of Highways, the National Road Planning and Supervision Work Unit (P2JN) Riau Province and PT. Indec Internusa has complied with the legal requirements of an agreement. However, in the implementation of the construction of Duri-Kandis-Siak II Road Construction Supervision in Riau Province where PT. Indec Internusa did not fulfill its achievements. And as for the settlement of disputes against default by PT. Indec Internusa is carried out in a non-litigation manner, namely the settlement of cases outside the court prioritizing a sense of togetherness where PT. Indec Internusa is subject to sanctions, namely contract cuts by 10% of the contract value, besides that PT. Indec Internusa is required to complete work as soon as possible.
