Abstract

Regarding the legal protection of women with disabilities based on Law Number 8 of 2016 concerning Persons with Disabilities, legal protection that can be provided is in the form of facilitating access to public facilities, facilitating access to health services, facilitating the education process and facilitating employment because everyone Persons with physical, intellectual, mental, and/or sensory limitations in the long term which in interacting with the environment may experience obstacles and difficulties to participate fully and effectively with other citizens based on equal rights. As a constitutional state based on the 1945 Constitution, Indonesia must guarantee respect, protection and fulfillment of the rights of women with disabilities as human rights that must be respected. The formulation of the problem in this study is First: how is the legal protection for women for the rights of persons with physical disabilities in Pekanbaru City. Second, what are the forms of discrimination against women for the rights of persons with physical disabilities in Pekanbaru City. In this research, the writer uses the type of empirical sociological research method, namely the type of research conducted by non-doctrinal or survey method in which the writer conducts a direct survey to the field. The nature of this research is descriptive qualitative, then the data used are primary and secondary data. While the data collection tools the author uses observation, interviews, and documentation. In drawing conclusions, the author uses the method of deductive thinking, namely a general statement into a specific statement. Regarding the results of the research and discussion that the authors found: First, the legal protection of women for the rights of persons with disabilities is still low and has not been implemented in accordance with the Riau Province Regional Regulation Number 18 of 2013 concerning the Protection and Empowerment of Persons with Disabilities. People with disabilities still feel discrimination in various fields of life and livelihood. Second, regarding forms of discrimination against women with disabilities considering the lack of maximum fulfillment of the rights of persons with disabilities as regulated in Law Number 8 of 2016 concerning Persons with Disabilities. That various forms of discrimination are still felt by women with disabilities such as discrimination in the realm of work, health, education, accessibility, violence, as well as discrimination in the realm of family and society.
