Abstract

In this day and age, teenagers are very easily influenced by their friends and fall into promiscuity, where they commit acts that are prohibited by religion and violate societal norms. This causes a lot of negative things for them, one of which is pregnant out of wedlock, resulting in early marriage. Early marriages that have not yet reached the age of 19 years can request a dispensation to the Court with urgent reasons. Marriage dispensation is a waiver granted by the court to a prospective husband or wife who wants to carry out a marriage, where the age of one or both of the prospective bride and groom has not reached the age limit that has been regulated in the UUP The problem in this study is what is the background of the Pekanbaru Religious Court Class 1A judge giving marriage dispensation to minors because they are pregnant out of wedlock and what are the legal consequences of giving marriage dispensations to minors because they are pregnant out of wedlock. The method used to answer the problems in this study is a sociological empirical research by conducting field research at the Pekanbaru Class 1A Religious Court, while it is descriptive, and the data used are primary data and secondary data. The results of this study indicate that the reason behind the Pekanbaru Class 1A Religious Court Judge giving a marriage dispensation to minors because they are pregnant out of wedlock, namely because the judge has listened to information from the Petitioner, Child, Prospective Husband/Wife, and Parents/Guardians of Prospective Husband. / The wife and has considered the information from the parties concerned, and has examined the terms and evidence that has been submitted by the applicant. As well as the legal consequences of granting marriage dispensation to minors due to pregnancy out of wedlock, namely by being given a marriage dispensation, minors can carry out marriages. has obtained a marriage dispensation permit, then the status and position of the child is clear, and there is a husband and wife position.
