Abstract

Lately, there are often problems regarding work agreements, where in the work agreement there is a clause that imposes a burden on the worker, such as withholding a worker's diploma for the duration of the work contract. This happens because the number of job seekers is not proportional to the job field and then the number of necessities of life is increasing, the panic that makes job seekers finally decide to accept the job offered in any form as long as the person concerned gets a job. This can be understood because Law Number 13 of 2003 concerning Manpower and the Civil Code do not explicitly regulate the practice of withholding workers' certificates. The problem is how is the implementation of the detention of workers' diplomas by employers at PT. Garuda Ekspress Nusantara? How is the completion of the detention of a worker's diploma by an entrepreneur at PT. Garuda Ekspress Nusantara as a guarantee of work? The research method is observational research, namely by means of surveys or direct visits to the research location using data collection tools, namely interviews and questionnaires. Meanwhile, its nature is descriptive, that is, research that is intended to provide a detailed, clear and systematic description of the main research problems. The results of the study can be concluded that the implementation of the detention of workers' diplomas as job security at PT. Garuda Ekspress Nusantara has not been running well and optimally. Due to the obstacles faced, the company and workers have to complete it gradually as it should. To overcome this problem, it is advisable to understand and carry out obligations in accordance with what is written in the work agreement regarding the return of diplomas after the expiration of the work agreement and not to be forced to sign a work agreement.
