Abstract

Article 1548 of the Civil Code a lease is an agreement, with which one party binds himself to give to the other party other enjoyment of something, for a certain time and with payment of a price, which the party later agreed to the payment. Repeat leasing of leased objects to third parties is a things that are prohibited, without the knowledge of the consent of the owner of the object of the lease, in accordance with Article 1559 of the Civil Code. But in reality there are still many especially in the Vila Paus Permai housing estate, that the tenants repeat the lease to a third party without the permission or knowledge of the owner House. The main problem of this research is how is the transfer of rights? rent to a third party in a house rental agreement in housing Beautiful Whale Villa? and How is the legal protection of homeowners in transfer of lease rights to a third party in a house rental agreement in the Vila Paus Permai housing estate? The research method used in this research is by using empirical legal research, with data collection techniques namely the interview. Judging from the nature of this research, including descriptive research namely research that provides a detailed and clear description of the main research problem. The results of the discussion of this study are the implementation of the transfer of rights rent to a third party in a house rental agreement in housing Paus Permai Villa still has the transfer of lease rights carried out by tenant to a third party without the owner's consent and by offer the house he rents to a third party only by paying an amount of money in accordance with the remaining rental period which will be continued by the parties third, and the tenant provides proof of the payment receipt first together owner of the house to a third party to be used as collateral if the owner the house asks a third party and legal protection for the owner house in the rental agreement, among others, by Legal protection through the establishment of an agreement according to the rules in Article 1559 Civil Code and also legal protection through the fulfillment of reimbursement losses arising from the lease agreement .
