Abstract

Water transportation services are no different from other transportation services, it's just that because most ship users are poor people who are not yet “literate” of the law, he sees that most victims just surrender and do not file any legal challenges. Transportation accidents at sea must be considered not as a deliberate criminal act by the driver, but there must be a different attitude which does not necessarily blame the transportation crew, but also on the transportation manager, such as the sinking of the Sinar Bangun Motor Ship in the waters of Lake Toba. Based on the above background, the problem that will be answered in this thesis research is about Consumer Protection Against Users of Lake Toba Crossing Transportation at Simanindo Harbor Based on Law Number 8 of 1999 concerning Consumer Protection and the Constraints to Consumer Protection Against Users of Lake Toba Crossing Transportation in Simanindo Port Based on Law Number 8 Year 1999 Regarding Consumer Protection? This type of research is an observational survey by means of a survey, namely research that takes data directly from the population / respondent by conducting interviews and questionnaires as a means of collecting data, then processing the data taken so that conclusions can be obtained using the deductive method. Meanwhile, when viewed from its nature, this research is descriptive, namely research that explains in clear and detailed sentences. From the results of the research, it is known that Consumer Protection Against Users of Lake Toba Crossing Transportation at Simanindo Port Based on Law Number 8 of 1999 concerning Consumer Protection that consumer protection is not carried out by passengers as consumers of Lake transportation when crossing Lake Toba, this can be seen from sales excessive tickets for one transport ship, causing the ship to experience over passengers and goods being transported, as well as the security facilities contained in the ship such as the passenger life jacket/life jacket are not sufficient with the number of passenger capacity that has exceeded capacity. Constraints on Consumer Protection for Users of Lake Toba Crossing Transportation at Simanindo Port Based on Law Number 8 of 1999 concerning Consumer Protection, including: the port administrators are not responsible for selling tickets that are over capacity, there is no routine check on ships that are used as means of crossing transportation in Lake Toba, the unavailability of life jackets for the safety of passengers on board, poor management of the management of the crossing ports on Lake Toba.
