Abstract

ABSTRACT Education is a human right and is the national goal of the Indonesian nation which is regulated in the preamble to the 1945 Constitution and in the body of the 1945 Constitution, namely Article 31 Paragraph (1) and Paragraph (2). In Bengkalis Regency there are still many children dropping out of school, as many as 147 people. This is because the cost of education is not affordable by the lower classes of society so that as a result, the normative rights of children who drop out of school cannot be fulfilled by the Bengkalis Regency Government. This study formulated the main problems regarding the authority of the District Government towards the fulfillment of the Right to Basic Education based on Government Regulation Number 66 of 2010 concerning Management and Implementation of Education and the inhibiting factors in fulfilling the right to basic education following Government Regulation Number 66 of 2010 concerning Management and Implementation. Education in Bengkalis Regency. This research is a sociological or empirical law based on secondary data as a source of data in addition to primary data and field research. The data were analyzed qualitatively. The analysis results are presented descriptively. The results showed that the authority of the district government in fulfilling the right to basic education based on Government Regulation Number 66 of 2010 concerning the Management and Implementation of Education in Bengkalis Regency in 2018 has not yet been fulfilled. There are still many school-age children, especially elementary schools who have not received their rights to attend school and have dropped out of school. The inhibiting factor for the fulfillment of the right to basic education based on government regulation Number 66 of 2010 concerning the Management and Implementation of Education in Bengkalis Regency is that the Regional Budget (APBD) for education has not been maximally budgeted 20% following the mandate of the National Law, weak economic factors, lower quality of teaching staff and infrastructure.
