Abstract
According to Law No. 1 of 2011 on Housing and Settlements, people need housing facilities as a place to live. To meet the need for good and livable housing, people buy housing through housing developers. Various offers were made by developers to promote and market housing. In general, housing marketing is done by means of advertisements or brochures. However , public trust is often abused by developers in bidding on housing because the information provided by the developer is too much so that it makes consumers interested and the offer is different from using advertising brochures that are listed with the existing reality. The main problem in this research is how to form a house sale and purchase agreement between the developer and the consumer at PT. Alesha Jaya Abadi and how the implementation of legal protection for consumers in the sale and purchase agreement of houses at PT. Housing Alesha Jaya Abadi. The research method used is empirical research, namely by means of surveys, namely direct research to the research location using data collection tools in the form of interviews connected with laws and regulations and expert opinions as well as the basis of existing home buying and selling agreements. The nature of this research is descriptive, that is, it provides a clear and detailed description of an incident that occurs regarding the legal protection of a house sale and purchase agreement in PT. Alesha Jaya Abadi Pekanbaru. The results of this study are the form of a house sale and purchase agreement between the developer and the consumer at PT. Alesha Jaya Abadi has 3 (three) stages. The first stage is the existence of the Alesha Phase II housing order letter and the Alesha Phase II house sale and purchase agreement. The second stage is the arrangement of housing loans (KPR) and the down payment for Alesha housing Phase II. The third stage is the signing of the Alesha Phase II house sale and purchase deed as well as the submission of the object of the agreement, and the implementation of legal protection for consumers in the house sale and purchase agreement at PT. Alesha Jaya Abadi that the developer will guarantee the residents of the house if things happen for 90 days from the signing of the realization of the handover of the house (Minutes of the Handover of the House), but in reality the developer is not responsible for the building damage suffered by the residents of Alesha Jaya Abadi Housing Pekanbaru .
