Abstract

ABSTRACT Settlement of Bad Credit disputes by way of reconciliation through Mediation. This alternative dispute resolution is an out of court dispute resolution mechanism. This process is considered suitable because the Indonesian people are actually more familiar with traditional patterns of dispute resolution, namely through customary courts or village courts which have a philosophical basis of deliberation and consensus, rather than confrontational settlements such as in courts. The writing that the researcher wrote was entitled "Juridical Overview of Bad Credit Settlement for Savings and Loans Businesses Through Alternative Mediation at BUMDesa Damai Mandiri Sukadamai Village, Ujungbatu District, Rokan Hulu Regency". This study aims to find out how the process of implementing the mediation in the settlement of Bad Loans between customers who are in arrears and the BUMDesa and what obstacles often occur when the mediation process is carried out. The research method used is a type of sociological research (observation) which is seen from its descriptive analytical nature whose data uses primary data as the main data, that is, it goes directly to respondents to conduct interviews and uses secondary data as data to support the main issues to be discussed. Analysis of the data obtained by means of a qualitative descriptive which the researcher will later relate to the theory and legislation in accordance with the formulation of the research problem. The process of implementing the mediation began after a warning letter was given from the Bumdesa Damai Mandiri, Sukadamai Village, Ujungbatu District, Rokan Hulu Regency. After the parties are present according to the time and place that have been determined, then the Village Head as mediator opens the trial, and introduces the parties, then the bad credit customer explains the reasons and causes for the customer to be in arrears on installment payments, then Bumdesa provides assistance in resolving bad loans according to the customer's problem, then the parties make a letter of agreement in accordance with the agreement and the form of settlement obtained from the results of the mediation, this procedure is in accordance with the Supreme Court Regulation Number 1 of 2016 concerning Mediation Procedures. Some of the obstacles experienced during the mediation process were the absence of sanctions that created a deterrent effect, the customer and the Bumdesa not having a solution during the mediation process, the lack of knowledge and understanding and the lack of education about the laws and regulations governing loan agreements.
