Abstract

ABSTRACT DKPP was formed based on Law Number 15 Year 2011 concerning Election Administrators (Election Law), its authority is regulated in Chapter V concerning DKPP Articles 109 to 115. DKPP is an institution in charge of dealing with violations of the code of ethics of election administrators. Handling of Cases of Violation of the Code of Conduct for Special Election Administrators in Riau Province, in 2019 there were at least 3 (four) reports of cases of suspected violations of the election administration code of ethics that met the formal and material requirements to be examined and decided upon, and among them were proven to have violated the 2019 election code of ethics, including the KPU of Kampar, Siak and Kuantan Singingi Regencies. The main problems in this research are: 1) how is the application of sanctions for violations of the 2019 election code of ethics in Riau Province by the Honorary Council of Election Administrators (DKPP). 2) What are the inhibiting factors in the application of sanctions to election organizers who violate the election code of ethics. The research method used in this study uses an observational research approach, while by its nature this research is a descriptive study. Application of sanctions for violations of the 2019 Election Code of Ethics in Riau Province by the Honorary Council of Election Administrators (DKPP). In its decision DKPP gave warning sanctions to the defendants in Decision Number 306-PKE-DKPP / X / 2019 (KPU Kampar) and Decision Number 206-PKE-DKPP / VIII / 2019 (KPU Siak), as well as Stern Warning and Permanent Dismissal sanctions. Decision Number 107-PKE-DKPP / V / 2019 (KPU Kuantan Singingi) is correct in deciding and based on an assessment of the facts in the trial, examining the Complainant's testimony, examining the Defendant's answers and statements, examining witness statements and documentary evidence submitted Complainants and Defendants. Inhibiting factors in the application of sanctions to election organizers who violate the election code of ethics include the first after the issuance of the Constitutional Court (MK) Decision Number 31 / PPU-XI / 2013 concerning the Final Nature and Binding the Decision of the Honorary Council of Election Administrators (DKPP) to the second, Secretariat DKPP is still attached to the Election Supervisory Agency and thirdly, the implementation of the recruitment of Election Administrators and an imbalance in the organizational structure pattern.
