Abstract

ABSTRACT Humans are living beings who always need the help of other human beings. One of them is to buy and sell livestock such as Buffalo, cattle, goats and other livestock, generally done by way owners and sellers meet and make buying and selling transactions after agreed the number of livestock and the price then the livestock is brought and owned by the buyer, but another case with the sale and purchase of livestock that occurs in gema village kampar Kiri Hulu district, Because the object of buying and selling or farm animals can be purchased by means of sabolah (half part), then sakaki (one-quarter part), and saparlapan (one eighth part) of one livestock. The title of this study is "Juridical Analysis of Buying and Selling of Livestock Reviewed From The Sociology of Law (Study in Gema Village Kampar Kiri Hulu District Kampar Riau)" The main problem in this study is how the transaction process of buying and selling livestock in Gema village Kampar Kiri Hulu District then how the legal sociological review of the phenomenon of buying and selling livestock in Gema village Kampar Kiri Hulu District. This research is included in the type of empirical legal research or (obsevational research), which is research taking and obtaining data based on data obtained in the field. The data collection technique in this study is a NonProbability Sampling technique that uses the type of Purposive Sampling, In this study the sample in question is the head of Gema village, Community Leader Ninik Mamak Gema village and community des Gema who have done transactions to buy and sell livestock Sabolah (half), Sakaki (one-fourth), and Saparlapan (one eighth). The results of this study explain first, that the sale and purchase of sabolah livestock (half), Sakaki (one-fourth), and Saparlapan (one-eighth) is done by slaughtering only by choosing three ways, namely sabolah or half part of one livestock or sakaki means one-quarter part as well as saparlapan means one eighth part. After the estimated price of one livestock, the price is determined according to the part you want to buy. After knowing how and the process of buying and selling, the sociology of law looks at the phenomenon of buying and selling that occurs in gema village aims to know its philosophy and background. As for the philosophy and background that causes this buying and selling is an urgent economic need and usually the need must be met immediately and in small quantities. And some factors that show this transaction can occur are the distance of the community village at that time is very far from the city, then the work of the community that only farms and fishermen, and the harmony of principled indigenous peoples please help each other.
