Abstract
“Juridical Analysis of Cancellation of Regional Regulations and Their Effect on PAD Revenue (Study of Regional Regulations on Retribution for Reimbursement for Printing Identity Cards and Civil Registry Deeds of Karimun Regency, No. 1 of 2011) ” ABSTRACT Every year during 2001-2016, there were tens to thousands of problematic Regional Regulations (Perda). Finally, in 2016 there were 3,143 regional regulations that were canceled by the Ministry of Home Affairs (Kemendagri). Some of the annulled local regulations include those related to promoting regional economic levels, namely the Regional Regulation on Levies. The existence of testing of Regional Regulations carried out by the government is not fully accepted by the regions. In fact, many regions object if the Regional Regulations that have been made with difficulty, require a lot of money and take a long time, and involve people's representatives in the Regional People's Representative Council, are canceled by the Minister of Home Affairs. In this case, the Ministry of Home Affairs is of the opinion that Regional Regulations that have been ratified and made in the right way for the benefit of the people, cannot simply be annulled. Even if it is canceled, it must go through legal procedures in accordance with Article 7 of Law No. 12 of 2011 concerning the Establishment of Legislation. The main problem in this research is what is the basis for consideration and how to implement the cancellation of the Regional Regulation of Karimun Regency No. 1 of 2011 concerning Retribution for Reimbursement for Printing Identity Cards and Civil Registration Deeds by the Ministry of Home Affairs (Kemendagri) and their impact on Karimun Regency PAD. The research method used is observational research. The results of the research obtained through this study are to find out the basic considerations of the Ministry of Home Affairs (Kemendagri) in determining the cancellation of the Karimun Regency Regional Regulation No. 1 of 2011 concerning Retribution for Reimbursement for Printing Identity Cards and Civil Registry Deeds, namely because they are contrary to higher legislation, public interest and/or decency. Then, the cancellation of the Regional Regulation did not affect Karimun Regency's PAD. This is proven by the increasing PAD of Karimun Regency every year.
