Abstract

Dispute over termination of employment according to law No. 2 of 2004 concering the settlement of industrial relations disputes are disputes that arise because of the inconsistency of opinion regarding the termination of employment relations carried out by one of the parties. Industrial relations mediation is the settlement of disputes over rights, disputes of interest, disputes over termination of employment and disputes between trade unions/labor unions in one company that presents a neutral third party to provide input on the problems being experienced, the third party is referred to as a mediator. The main problem of the research is how the process of resolving industrial relations disputes between contract workes at PT Surveyor Indonesia Pekanbaru branch through mediation by the Riau Ptovince Manpower and transmigration office, and what is the role of mediators in resolving industrial relations disputes between contract workes at PT Surveyor Indonesia Pekanbaru branch through mediation. This reaserch is a sociological legal research that is a direct observation to a predetermined location or plce using interview as a date collection tool. While its nature descriptive, which is one of the characteristic of research that aims to present a clear and detailed picture of the main research problems. The results of the study indicate that the mediation process as a settlement of industrials relations disputes between contract works and PT Surveyor Indonesia Pekanbaru branch has been carried out by the Riau Province Manpower and Transmigration office referring to Law No. 2 of 2004 concering the settlement of industrials relations disputes, which begins with the registration process disputes, clarifications and offers, summoning the parties, conducting mediation sessions and issuing written recommendations because the disputing parties do not reach an agreement, and the role mediator oh the Riau Province Manpower and Transmigration office in the process of resolving industrials relations disputes between contract works and PT Surveyor Indonesia Pekanbaru branch is considered good, because the mediator is very helpful in the mediation process from beginning to end and in this process the mediator is neutral and impartial to one of the dispuiting parties.
