Abstract

The building contracting agreement is the same as a general agreement which is consular, namely an agreement that was born because of an agreement between the parties when they enter into an agreement so as to give rise to something legal relationship. In the implementation of the agreement when the contract is carried out by these parties, there are several issues regarding defaults in the period of work as well as the maintenance period of the work. The main problem is 1) how is the agreement between CV. Riau Sheen with PT. Plantation Nusantara V Sei Pagar which caused a defaultand 2) how are efforts made so that there is no default between the CV. Riau Sheen with PT. Plantation NusantaraV Sei Pagar. The research method used is field researchby finding data sources directly on PT. Plantation Nusantara V Sei Pagar and CV. Riau Sheen.The agreement between CV. Riau Sheen with PT. Plantation Nusantara V Sei Pagar which caused a default is caused by several problems, namely a delay in the process of building construction which should have been completed within 90 (ninety) days, but the contractor has only completed its work for 120 (one hundred twenty) days and submitted an application for an extension of time which is not in accordance with the provisions of Article 10 Paragraph 3 of work Implementation Agreement Number : 5 TEP/ NP/ 78-B/ IV/2018 On August 21,2018, the contractor also does not carry out the maintenance work period which should be carried out for 60 (sixty) days, but it only carried out for 30 (thirty) days, the contractor also did not want to be responsible for the damage that occurred. Efforts madeso that there is no default between the CV. Riau Sheen with PT. Plantation NusantaraV Sei Pagar, the contractor must be more careful and not only prioritize the target to be the winner of the tender, but also must carry out the mechanism contained in the contract and for the company must always oversee the process of construction of building works whether it has been in accordance with the provisions contained in the contract.
