Abstract

Default is a condition in which a person does not carry out what has been agreed upon together, this also occurs in the house rental agreement No. 60 RT 0 RW 01 Gang Fast Jalan Cipta Karya Kota Pekanbaru where a tenant defaults on the agreement that has been agreed between the owner of the house and the owner of the house. the tenant, as for the default, namely the damage to goods such as water machines, gates and walls that were scribbled on by the tenant, where based on a mutual agreement the tenant is obliged to replace the damaged goods but in reality the tenant does not replace or repair the damaged goods. The main problem raised in this study is how the form of default by a tenant on the rental agreement of a house located at Sepat Gang number 60 RT 0 RW 01 Jalan Cipta Karya Kota Pekanbaru and how the form of settlement efforts for this default is carried out. It is hoped that later on we will be able to find out what constitutes a form of default and later we can find a settlement of the default dispute on the rental agreement between the owner and the tenant of the house by upholding the values of justice. The method chosen in this study is to use empirical law, which is to see how far the law works in a society. The data collection tool was also chosen by conducting interviews with respondents. The results of this research conducted by the author conclude that there has been a form of default on the rental agreement of the house no. 60 RT 0 RW 01 gang sepat street copyright work in the city of Pekanbaru, namely damage to goods such as water machines, gates and walls that were crossed out. -strike but a tenant does not compensate for the default. To resolve the issue of this default, the parties agreed to choose a negotiated way to replace damaged goods and choose a peaceful family method.
