Abstract

The profession as a notary official has long been known, and even since Indonesia has not been independent, precisely since the 17th century. The position of a notary as a legal system in Indonesia is to serve the community in the field of civil law, especially in terms of making evidence for a legal act or legal event. The cancellation of an authentic deed cannot be done immediately, because the authentic deed is a perfect evidence to guarantee the truth of a legal act. Notaries and their products in the form of a deed can be interpreted as an effort by the state to support the creation of legal certainty and protection for every member of the community. Based on this background, the main problem in this research is whether the factors that cause the deed at the Melly Tri Yenny Alidin S.H notary office to be canceled and what is the responsibility of the notary profession for the cancellation of the deed carried out by the parties. The research method used is sociological legal research in which the type of legal research is carried out by analyzing and examining a problem directly, either by interview or by making an observation. Based on the results of the study, it can be understood that the cancellation and cancellation of a notarial deed can occur due to several things that do not fulfill the objective requirements, absolute incompetence, inability to act, relative incompetence, contrary to the law, and default as a condition for cancellation. If in the deed only one party signs, it cannot be said that there has been an agreement between the parties. And the notary is responsible for ratifying the cancellation made by the parties.
