Abstract

The state’s ideology as the fundamental norm must be coherent with the legal system that is built because ideology is the beginning and the end that must be achieved in a state. In fact, in Indonesia, the formation, implementation, and enforcement of the law is not based on Pancasila but is based on and aims at the ideals of liberalism law. This paper aims to analyze the Pancasila legal system with the framework of the Pancasila ideological reasoning method. The author uses a systems approach, semiotics, history, and concepts, using secondary data. Qualitative data analysis was built with analysis-synthetic arguments to conclude. The analysis results show that the reasoning method symbolized on the Garuda Pancasila mandala shield is a form of the concept of balance and pyramidal compounds. The current structure of the Pancasila Law System reasoning method, which is prismatic, is not coherent with the Pancasila method of reasoning, which is actually a pyramidal shape. As a philosophy and State Basic Norms, Pancasila must be derived from the state legal system, so that the Pancasila legal system must be in a pyramidal shape, which places Pancasila as the pinnacle of the formation, implementation, and enforcement of state law. Therefore, the reasoning method of Article 1 paragraph 3 of the 1945 Constitution needs to be amended so that the editorial of the basic legal idea that “Indonesia is a State of Law” will change to “Indonesia is a State of Law of Pancasila”. This change will build a legal paradigm that is genuinely based on Pancasila.
