Abstract

ABSTRACT Nowadays, can easily travel by using online transportation, for example using an online motorcycle taxi. Online motorcycle taxis are muamalah activities, so that it is easier for people to carry out all their activities with cellphones. The development of technology, especially in the internet, nowadays gives a user a positive impact and a negative impact on the user. The existence of this online motorcycle taxi service makes it easy to help people's daily activities, because when someone is busy and wants to do other activities, for example buying food, there is no need to bother buying the food and no need to jam on the road, just order via the ojek application. on line. In this study, the researcher has a formulation of the main problem that wants to be discussed, namely, How is the payment sistem for food purchasing services through online motorcycle taxis and then what is the view of Islamic law and positive law about purchasing food through online motorcycle taxis The research method that researchers use in this thesis is normative research. What is meant by normative research is a research procedure that uses secondary data in the form of case studies, laws and regulations, written legal theory. The nature of this research is analytical descriptive, namely. Meanwhile, seen from its nature, this research is an analytical description, which is a research method to provide an overview of the relationship that occurs between these events and the problem to be investigated by researchers. Based on the results of research and discussion, it can be concluded that a positive legal perspective allows ordering food through online motorcycle taxis and Islamic legal perspectives that legalize buying and selling transactions through food ordering services through online motorcycle taxis based on a legal basis in the Qur'an, Surat Al-Kahfi verse 19. , and the hadith of the Prophet Muhammad SAW narrated by Bukhari, which allows representing purchases (wakalah bil ujrah) and views the use of online motorcycle taxi driver services as Ijarah paid on the basis of sincerity. The perspective of Islamic law which prohibits buying and selling transactions through food ordering services through online motorcycle taxis is based on the legal basis in the Qur'an Suarat Al Baqarah verse 275 and the Hadith of the Prophet Muhammad SAW narrated by Bukhari which prohibits usury and considers that there is a merger of contracts (al 'uquud al murakkabah) whose law is haram.
