Abstract
This study discusses an implementation of a credit agreement between creditors and the Pematang Jaya Village-Owned Enterprises (BUMDes) in Pematang Berangan Village, BUMDesa is a village business managed by the Village Government, which aims to improve the economy and welfare of rural communities, in accordance with the mandate of the Constitution 1945 to 4th Century. Basically BUMDesa provides loans to the community in the form of business loans, credit creates a receivable agreement. In providing credit BUMDesa must adhere to the principle of prudence. From the above background, the problems studied were how the implementation of the loan agreement between the Pematang Jaya Village-Owned Enterprises (BUMDes) and the communities in Pematang Berangan Village and how to settle defaults in Pematang Jaya Village-Owned Enterprises (BUMDes). In this study the type of research used is observational research by means of a survey, with the sampling method is purposive sampling which is sampling that is only adjusted to the purpose of the study, in order to achieve the aims and objectives in this study. In accordance with its title, the author's research location is Pematang Jaya Village-Owned Enterprises (BUMDes) in Pematang Berangan Village, Rambah District, Rokan Hulu Regency. The population in this study were 38 creditors in Pematang Brtangan Village. Then the sample is 20 people from Pematang Berangan Village. From this research, it can be concluded that the implementation of the agreement for the granting of credit between the Pematang Jaya Village-Owned Enterprises (BUMDes) is by submitting and filling in and signing the Credit application and its appropriateness by the Pematang Jaya Village Military Enterprise (BUMDes). If it is deemed feasible, the signing of the credit agreement and the signing of the Collateral Sales Proxy letter will be carried out and disbursement will be hastened, while the settlement of the loan agreement in the loan agreement (SP2K) does not have strong legal certainty in the collateral seizure, because the debtor when giving a reprimand and accompanied by a fine the creditor still has not paid the loan installment until the third warning letter, then the last way is by confiscating or auctioning the creditor collateral to pay off the credit shortfall of the customer, even though the Pematang Jaya Village Ownership Agency has never do collateral collateral.
