Abstract

This thesis aims to discuss the legal protection for workers who have lost their jobs based on Government Regulation (PP) Number 37 of 2021 on The Job Loss Security Program. Since the Corona Virus Disease (Covid-19) outbreak, the number of workers experiencing layoffs is increased, and it may cause some issues. Termination of employment is feared to decrease the level of workers‟ welfare so that the government issued Government Regulation (PP) Number 37 of 2021. Therefore, in this research, legal protection for workers after the ratification of Government Regulation (PP) Number 37 of 2021 will be discussed further. Based on the background of this study research, the formulation of the problem: (1) How is the legal protection for workers who lose their jobs based on Government Regulation Number 37 of 2021 concerning the Implementation of the Job Loss Guarantee Program (2) How the implementation of the Job Loss Security in Indonesia compares to another country? This thesis research uses a normative juridical method with a statutory approach and a conceptual approach. The primary, secondary and tertiary legal materials obtained by the researcher will be analyzed using grammatical interpretation analysis techniques, systematic interpretation and sociological interpretation. From the research method above, the researcher will find out the results that the Government Regulation (PP) Number 37 of 2021 on Job Loss Security Program is a new regulation in following the mandate of Article 28D of the 1945 Constitution of the Republic of Indonesia. It becomes evident that the state is present in providing legal protection related to severance pay through job loss guarantees so that workers affected by the termination of employment are protected for a certain time while looking for new jobs. Each country creates an unemployment insurance policy with a different model but they still want to achieve adequate protection against the risk of losing their jobs by expanding coverage to ensure that workers affected by layoffs receive compensation.
