Abstract

This thesis discusses about the hospital's responsibility to the visiting doctor as well as the authority of the doctor associated with the health law. This thesis also took the case to be analyzed, the case is the Cassation Decision Number 1110K/Pid.sus/2012. It can not be denied, in tis globalization era then the diseases are also a lot of emerging that makes the hospital requires a doctor by making a contract work with the easy way. The issue in this research is the emergence of medical practice without the existence of a Practice License which according to the Act is a violation. The purpose of thesis is to find out and discuss more about when doctors are said to be competent and get the authority and what kind of responsibility of the hospital against doctors based on their contract type. This research method is literature research with prescriptive type. The results of the study concluded that the hospital also has a influence of the violations that occurred, because the hospital must pay attention to the doctor's Practice License when they want to make a doctor recruitment, if a doctor does not have Practice License then the hospital proven to violate the hospital law for employing a doctor who does not complete the requirements of practice in that place.
