Abstract

The role of BUMN as a state company has positioned it as a business entity that has special characteristics. Besides the demand to generate profits and have a profit value for the state, BUMN is also attached to a non-commercial function in carrying out the goals of the welfare of the people which are the goals of the state. BUMN Persero as a form of BUMN has been determined to be managed based on the mechanism stipulated in the Limited Liability Company Law, however, the capital to form BUMN originating from separated state assets is still categorized as part of state finances. Various state institutions have a place to supervise and examine the performance of BUMN Persero like public institutions. The inconsistencies in the regulations governing the existence of BUMN Persero become something that is not in favor of the goal of establishing BUMN, namely realizing the goals of sustainable development. This is because BUMN Persero is managed based on two legal regimes whose principles are mutually contradictory, so that it causes significant losses, due to the existence of a regulation that burdens BUMN, in this case PT PLN (Persero), not only has an impact on the company itself, but will also harm the State's finances. This study aims to identify the causes of financial loss or deficit experienced by PT PLN (Persero) arising from the sale and purchase of electricity between PLN and private business entities based on the Permen ESDM No. 10 Tahun 2017 tentang Pokok – pokok dalam PJBL. The benefit of this research is to increase awareness of the aims and objectives of the formation of state enterprises (BUMN), as the only utility company that can sell electricity to the people, PLN should be a source of state revenue, but quite the opposite. With the type and nature of juridical - empirical research and interview data collection techniques and documentation. The results of the study are in the form of facts that show that there is a financial loss or deficit of PT PLN (Persero) in 2020 as a result of the arrangement of the sale and purchase of electricity between PLN and private business entities based on Permen ESDM No. 10 Tahun 2017 tentang Pokok – pokok dalam PJBL.
