Abstract
ABSTRACT Consumers whose existence is very unlimited with very varied strata cause producers to carry out marketing activities and distribution of goods or services in the most effective manner possible in order to reach very diverse consumers. Many business actors use hazardous additives, one of which is borax, these dangerous substances can cause health problems such as cancer, if they are excessive or in the long term, they can even cause death. The borax substance does not meet the requirements as a food additive by the Central for Drug and Food Control. The formulations of the problems used in this thesis research are: First, How is law enforcement enforced against business actors who sell food containing borax substances by the Central Food and Drug Administration in Pekanbaru? Second, what are the obstacles faced in law enforcement against business actors who selling food containing borax substances by the Food and Drug Supervisory Center in Pekanbaru, Third, how are the efforts to overcome the obstacles faced in law enforcement against business actors selling food containing borax substances by the Central Food and Drug Administration in Pekanbaru? The type of legal research is juridical sociology. This research was conducted by going directly to the field to collect primary data, and using descriptive methods. Meanwhile, if viewed from the nature of this research is descriptive. This study uses secondary data, namely ready-made data. From the results of the research on the problem, there are three main things that can be concluded, First, this is law enforcement against business actors who sell food containing borax substances by the Central Food and Drug Supervisory Agency in Pekanbaru which has not been maximized, such as only giving administrative sanctions in the form of a warning The perpetrator was only given a warning. and food evidence containing borax was confiscated. Second, the obstacles faced in law enforcement are the inadequate application of laws and regulations to business actors, especially in the application of firm sanctions, the lack of professionalism of law enforcement officials, insufficient and useful information for the public regarding foods containing food. hazardous materials such as borax, the low economic factor that causes business actors to seek profit in the wrong way, and low legal awareness of the community. Third, efforts to overcome obstacles are through preventive measures including: regulation or regulation of processed food products; and fostering business actors, consumers, and field supervisors related to the prohibition on the use of borax in processed food. Repressive actions include the application of administrative sanctions or the application of criminal sanctions in the form of imprisonment or imprisonment, and fines for violators.
